Beyonce And Jay-Z's Blue Ivy Trademark: An Expert Explains

Couple likely 'trying to protect what they rightfully own or created,' family law expert tells MTV News.

<P>Beyoncé</a> and Jay-Z have filed an application with the U.S. Patent and Trademark Office to protect their month-old baby's name and reserve it for future use, MTV News has confirmed. The superstar couple reportedly sought the trademark to stop the use of Blue Ivy's name by others. </P><P> </P><P></p><div class="player-placeholder right" title="A Gift Buying Guide For Blue Ivy Carter" id="vid:725377.id:1676907" width="240" height="211"></div><p> </P><P> </P><P>It's a smart move, according to family law attorney and author Vikki Ziegler. "[Seeking the trademark] forestalls competitors from using the child's name and or third parties from attempting to sell the baby's name back to the couple," Ziegler told MTV News. "They are likely trying to protect what they rightfully own or created, shall we say, by trademarking Blue Ivy's name." </P><P> </P><P>The application to trademark Blue Ivy Carter's name, filed by BGK Trademark Holdings (Beyonc&#233;'s company) is currently pending but will likely be approved because, as the Washington Post reports, parents are legally authorized to trademark the names of their minor children. </P><P> </P><P>"In essence, it's a trademark for a brand, and this brand is expected to be one hot commodity &#8212; just look at Blue Ivy's parents," Ziegler said. "Anyone else that tried to use the name after the trademark was approved could be sued and held liable for damages." </P><P> </P><P></p><div class="player-placeholder right" title="Beyonce Will Emerge As A Hollywood Celebrity Mother Brand" id="vid:724613.id:1676907" width="240" height="211"></div><p> </P><P> </P><P>While the Patent Office looks fondly on attempts to trademark the name of one's own child, attempts to do the same with the names of other people's kids are another story, as two designers learned when they sought &#8212; just days after Blue Ivy's birth &#8212; to trademark the baby's name for their own use. </P><P> </P><P>Applications from fashion designer Joseph Mbeh to patent "Blue Ivy Carter NYC" and by an unnamed designer to trademark "Blue Ivy Carter Glory IV" for a fragrance line were denied by the Patent Office, which noted in its decision that the name belonged to a "very famous infant" and consumers would wrongly assume that any products bearing the name had been approved by Beyonc&#233; and Jay-Z. </P><P> </P><P>Ziegler noted that the trademark would "protect against others using the child's name as a brand of merchandise in the same marketplace," so it will not impact the "Blue Ivy" trademark held by a clothing boutique in Sturgeon Bay, Wisconsin. The store filed to trademark <i>its</i> name on January 19, 2011, a year before Queen B and Jay made the name famous. Game Says Going Independent May Be A 'Really, Really Good Move'

Rapper's fifth LP, F.I.V.E., could be his last album with Interscope.

Game only has one LP left on his Interscope contract, and after he drops the follow-up to 2011's The R.E.D. Album, the platinum-selling Compton rapper will contemplate his musical independence.

"Independent. That seems like a really, really good move where I can capitalize off of all the finances being made off of my music for once. But, I don't know, I kinda like having a lot of help, a lot of assistance from a big label," Game told MTV News on Thursday. "I don't know, maybe we'll have a meeting about a lot of money or I'll be talking to my conscience."

Earlier this month, Game announced his new album title, F.I.V.E., to XXLMag.com, but it may be some time before it hits shelves. "I haven't even started working on it yet. I first came up with the album title, which is F.I.V.E., and then came up with its acronym, which is Fear Is Victory's Evolution," he explained to MTV News. "It's got a good concept, and once the budget is open on that I'll get to rolling."

Game, who was the subject of Thursday night's "Behind the Music" on VH1, is reluctant to offer up anything resembling a release date due to the multiple push-backs that he's experienced with The R.E.D. Album. "You what I learned from this last album is to never give anybody a date to anything; I'll let the label do that when it's time," he said.

On Wednesday, Game released his "The City" video with Kendrick Lamar. But it looks like that will be the last single he drops off of The R.E.D. Album. "Personally I'd like to just move on and get the budget open for my fifth album, which is something I don't think Interscope is too much in a rush to do, being that it's my last contractual, obligated album on the label," he said. "I would love to just keep it rolling."

'Glee' Michael Jackson Episode: Rumored Set List Leaks

Perez Hilton reports that January 24 episode includes a 'Beat It' and 'Billie Jean' mash-up.

<P>"Glee" has already dedicated entire episodes to Madonna, Britney Spears and Lady Gaga, and come 2012, it's the King of Pop's turn. </P><P> </P><P>A rumored set list for the January 24 "Glee" Michael Jackson tribute episode has hit the Web, and it features some of the late singer's greatest hits. Perez Hilton reports that 14 tracks have made the final cut, although the list has yet to be confirmed by anyone connected with the show. </P><P> </P><P></p><div class="player-placeholder right" title="'Glee' Cast Members Talk Michael Jackson Episode" id="vid:549513.id:1645343" width="240" height="211"></div><p> </P><P> </P><P>The set list (along with who will perform the track) reportedly includes "Wanna Be Startin' Somethin' " (Blaine), "Bad" (the New Directions and the Warblers), "I Just Can't Stop Loving You" (Finn and Rachel), "Smooth Criminal" (Santana and Sebastian), "Never Can Say Goodbye" (Quinn), "In the Closet" (Brittany and Santana), "We Are the World" (the New Directions and the Warblers), "Black and White" (Puck), "Ghost"/"Monster" (New Directions), "Beat It"/"Billie Jean" (Warblers), "The Way You Make Me Feel" (Kurt) and "Don't Stop 'Til You Get Enough" (Artie). </P><P> </P><P>This is hardly the first time the show has paid homage to Jackson. Back in 2010, the New Directions performed his track "Thriller," complete with zombie garb, during an episode that aired after the Super Bowl. The show has also previously covered "P.Y.T. (Pretty Young Thing)" and "Man in the Mirror." </P><P> </P><P>Back in 2010, the cast of the hit Fox show had only imagined what it would be like to have an entire episode dedicated to Jackson. "I would love to do a Michael Jackson episode," Amber Riley told MTV News at the time. "You know, it's so many [songs that I love], but my favorite song by him is 'Human Nature.' I love that song." </P><P> </P><P>While Riley seemed psyched about the opportunity, castmate Jenna Ushkowitz found the possibility a little more daunting.
